Arizona’s Legislature Greenlights AZ ICE Act to Boost Federal Immigration Collaboration

Arizona’s legislature has enacted SB 1164, known as the “AZ ICE Act,” which is now awaiting inspection by Governor Katie Hobbs. This legislation, spearheaded by Senate President Warren Petersen (R-LD14), aims to enhance cooperation between state and federal authorities regarding immigration enforcement.

Passed along party lines in the Arizona House, the bill prohibits local governments from implementing policies that hinder collaboration with federal immigration agencies. It outlines a compliance enforcement mechanism, enabling the Arizona Attorney General to investigate potential violations under Arizona Revised Statutes §41-194.01, also known as “1487 investigations.” Cities or counties found to be non-compliant could face state revenue withholding.

Petersen praised the bill’s passage, highlighting its intent to protect communities from “dangerous criminal illegal aliens.” He urged the Governor to prioritize safety over political considerations.

The AZ ICE Act mandates that state and local agencies facilitate federal immigration enforcement, requiring county sheriffs and the Arizona Department of Corrections to respect immigration detainer requests. Additionally, it permits law enforcement to enter 287(g) agreements with the federal government, allowing local officers to carry out specific immigration enforcement tasks.

This legislative move aligns with similar initiatives in other states amidst ongoing national discussions about border security and immigration policy. Proponents maintain that such actions are crucial for preventing the release of undocumented immigrants with criminal histories and ensuring local support for U.S. Immigration and Customs Enforcement (ICE).

If signed into law, the AZ ICE Act will officially take effect later this year, further positioning Arizona as a pivotal player in the national immigration debate.
