Phoenix officers told a father to 'drag' and 'beat' his teen before officers assaulted teen, civil rights attorney says


PHOENIX — A civil rights attorney is pursuing $500,000 in damages for a teenage boy allegedly assaulted by police officers. This claim, filed by attorney Larry Wulkan of Zwillinger Wulkan PLC, highlights disturbing conduct captured on bodycam footage.

On January 23, 2024, Sergio Nino III’s father called law enforcement over struggles in managing his son’s behavior during an argument. Upon arrival, officers are heard suggesting that the father discipline the teen by beating and dragging him.

“You drag him. You drag him, you hit him,” one officer reportedly instructed, stating, “If you wish to beat him, you can beat him.” The officers implied that if child services were contacted, reports of physical discipline would be dismissed.

Interactions escalated when officers knocked on Sergio’s door to address the situation. When the teen resisted, one officer threatened him by saying, “Because you are being a little brat.” Tensions mounted as Sergio attempted to present evidence of his father’s alleged assault. In this moment, an officer seized his phone, leading to a physical altercation that resulted in Sergio being taken to the ground.

Footage revealed blood on the floor from facial injuries sustained by Sergio, which required stitches, alongside a fractured wrist that necessitated surgery. Legal representatives noted the officers’ failure to acknowledge reports of child abuse from both Sergio and his sister, despite their obligations as mandatory reporters under Arizona law.

The notice of claim serves as a precursor to a potential lawsuit against three officers and the City of Phoenix. Wulkan indicated that if the matter is not resolved, they would pursue a federal lawsuit against both the city and the involved officers.
