Dena Devine Indicted for Fatal Crash—But the Shocking Case Gets Dismissed!

Nearly one year prior, Dena Devine allegedly struck Piergrossi while driving under the influence of drugs and alcohol. Despite her admission, she has yet to face jail time. The first hearing concerning her case took place ten months later and concluded abruptly.
On October 9, 2023, charges against Devine for driving under the influence were dismissed by a Pinal County grand jury, indicating that the court found insufficient grounds to proceed at that moment. Devine was operating her 2020 Subaru Outback when the collision with Piergrossi’s motorcycle occurred; he sustained fatal injuries and died instantly.
A judge dismissed the DUI charges without prejudice, allowing for the possibility they could be reinstated or replaced by manslaughter accusations in the future. A scheduled hearing for November 15 is shrouded in secrecy, as details remain sealed in court records, and inquiries to prosecuting attorneys have gone unanswered.
Witness accounts suggest Piergrossi was riding at a speed as high as 100 miles per hour, although one officer assessed his estimated speed at the time of the crash to be around 55 miles per hour in a 45-zone. This detail emphasizes ongoing questions about accountability in this tragic incident.
Officer Adam Abel reported an unmistakable smell of alcohol on Devine the night of the accident. During questioning, she indicated she had consumed three to four beers. A passenger in her vehicle corroborated that they had both drunk approximately the same amount.
Blood samples were taken from Devine after the crash for analysis, and drug testing was conducted as part of the ongoing investigation by the Pinal County Vehicular Crimes Bureau. The investigation also secured a court warrant to access the “black box” of her vehicle, which logs critical data prior to collisions.
Despite these developments, the Eloy Municipal Court case remains pending and continues to attract attention. The contrasting elements of speed, alcohol consumption, and unresolved accusations highlight the complexities and legal implications stemming from this tragic accident.
