Democrat Commissioner Tovar Faces Scrutiny Over Potential Ethics and Legal Breaches

During a recent meeting, the Arizona Corporation Commission (ACC) unanimously authorized an investigation into Democrat Commissioner Anna Tovar amid allegations of legal and ethical misconduct. The vote, which occurred in her absence, passed with a 4-0 majority.

ACC Chairman Jim O’Connor expressed disappointment over Tovar’s absence, highlighting a lack of courtesy given her earlier indication of attendance. This sentiment set a serious tone for the meeting.

Following a brief executive session, O’Connor presented a motion directing the Office of General Counsel to probe allegations against Tovar and her staff. He specifically mentioned potential violations related to disclosing confidential personnel information and claims of harassment toward ACC employees.

General Counsel Tom Van Flein was tasked with conducting the inquiry swiftly, with a ten-day timeline for a report back to the commission. This timeline suggests the investigation’s findings could be available by early December.

Included in the allegations is a review of past conduct involving J.P. Martin, who held the position of Legislative Liaison & Public Information Officer at the ACC last year before leaving for a role with Arizona Secretary of State Adrian Fontes.

Commissioner Tovar, who previously served as an Arizona State Senator, announced in February her intent not to seek reelection. She is expected to step down from her position in January 2025. Tovar’s decision was motivated by a desire for change within the Commission, which she articulated in a social media post, stating the need for renewed focus on public service.

As the lone Democrat on the commission, Tovar will be succeeded by newly elected Republican commissioners Rene Lopez and Rachel Walden in early 2025. Her political career includes serving in both the Arizona House and as Mayor of Tolleson, along with a background in education.

Despite efforts to reach out, Commissioner Tovar did not respond to requests for comment regarding the ongoing investigation at the time of publishing.
