The Arizona Department of Education has launched a new webpage that lists schools complying with the Trump administration’s directives regarding diversity, equity, and inclusion (DEI) programs. This initiative coincides with ongoing legal disputes about DEI in public education across the nation.

Earlier this month, the U.S. Department of Education provided guidance mandating that schools submit compliance letters affirming they do not engage in DEI practices deemed discriminatory. Noncompliance could result in loss of federal funding. In light of this, Arizona Superintendent of Public Instruction Tom Horne has introduced a tracking site to ensure transparency regarding which schools adhere to these requirements.

“I am committed to following the law and will abide by the latest guidance from the U.S. Department of Education to take no action against schools until further notice,” Horne stated.

This federal guidance has generated legal challenges and confusion among educators, as many are unclear on what constitutes DEI. Two federal judges have already intervened in these matters. Notably, U.S. District Judge Landya McCafferty of New Hampshire criticized the vague language in compliance letters for failing to clearly define DEI initiatives or their alleged violations of civil rights laws.

Despite the prevailing legal uncertainty, Horne has expressed robust support for the federal stance. “Federal law and the 14th Amendment make it clear that no person should face discrimination because of race, skin color, or ethnicity, and this guidance aligns entirely with my philosophy,” Horne remarked. He argued that DEI programs effectively promote racial discrimination.

Horne believes the current DEI restrictions will be upheld by the U.S. Supreme Court and has urged Arizona school districts and charter schools to take the matter seriously.

The Arizona Department of Education’s DEI compliance page is available for public viewing.
