Trinity Develops Bold Plan to Privatize Roadways in Havasu Foothills Estates

The Lake Havasu City Council is set to deliberate a new development agreement on Tuesday, which concerns the developer of Trinity at Havasu Foothills Estates. The proposed plan will designate all roadways within the development as private.

This move comes as a modification to an existing agreement with MDCAB, LLC, established on August 23, 2023, which covers only 24 of the 90 lots within the estate. Should the new agreement receive approval, the prior one will be rendered void.

Council communication documents reveal that the revised agreement will delineate the responsibilities of the developer regarding the installation and upkeep of a private lift station, private force main, and the private roadways. This encompasses a broader scope, now addressing 90 out of the 697 total lots permitted in the area.

Under the new terms, the development’s roads will be owned by the developer along with a homeowners association. Consequently, these entities will bear the responsibility for maintenance, repairs, and overall upkeep of the private streets.

Despite this shift to private roadways, the developer must ensure reasonable access for all property owners within Trinity. Additionally, emergency services will retain their required access at all times, as stipulated by law.

Key elements of the previous agreement will persist, including the developer’s obligation to construct a private water and sewer lift station. This facility will also be privately maintained, with no plans for additional lift stations in the phases associated with Trinity.

The council is scheduled to vote on the new agreement in their upcoming meeting on Tuesday, September 10. The public is invited to attend the session, which will commence at 5:30 p.m. at 92 Acoma Blvd.
